Terms of Use (End User License Agreement)
These Terms of Use ("Agreement") are a legal agreement between you ("User") and TeslSizzo ("we", "us") governing your use of the TeslSizzo mobile app, its smartwatch versions (Wear OS and Apple Watch) and related web services (the "App"). By downloading, installing or using the App you agree to be bound by this Agreement. If you do not agree, do not install or use the App.
1. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any compatible device that you own or control, solely for your personal use, subject to this Agreement and the usage rules of the store from which you downloaded the App.
2. The Service and your Tesla account
TeslSizzo lets you send commands to and view information from your Tesla vehicle (lock/unlock, climate, charging, trunk/frunk and more) from your phone and smartwatch. TeslSizzo communicates with your vehicle exclusively through Tesla's official Fleet API, using the authorization you grant through Tesla's own sign-in (OAuth) flow. We never ask for or store your Tesla password. You may revoke TeslSizzo's access at any time from your Tesla account. You are responsible for using the App only with a vehicle you own or are authorized to control.
3. Independence from Tesla
TeslSizzo is an independent application and is not made, endorsed, sponsored by or affiliated with Tesla, Inc. Tesla, Model S/3/X/Y, Cybertruck, Roadster and the Tesla logo are registered trademarks of Tesla, Inc. We claim no ownership of these marks and have no commercial relationship with Tesla.
4. Your account
To use the App you must register for an account. You are responsible for keeping your credentials confidential and for all activity under your account. You agree to provide accurate information and keep it up to date.
5. Free trial and auto-renewable subscriptions
The App offers a 7-day free trial followed by optional paid membership plans (Watt, Kilowatt and their "+" tiers) with monthly or yearly billing. By purchasing a subscription you agree to the following:
- Title and duration: the name of the plan and its length (monthly or yearly) are shown in the App and in the store listing before you confirm the purchase.
- Price: the price is shown before you confirm the purchase and is charged to your Apple ID or Google Play account.
- Auto-renewal: your subscription renews automatically at the end of each billing period at the then-current rate unless auto-renew is turned off at least 24 hours before the end of the current period.
- Account is charged for renewal within 24 hours prior to the end of the current period.
- Managing / cancelling: you can manage your subscription and turn off auto-renewal from your account settings in the App Store or Google Play after purchase.
- Free trial: any unused portion of the free trial is forfeited when you purchase a subscription.
- Refunds: refund requests are handled according to the policies of the Apple App Store or Google Play, not by TeslSizzo directly.
6. Bring Your Own Credentials (BYOC)
Certain plans let you register your own Tesla developer credentials and signing keys ("BYOC"). When you use BYOC, you are responsible for complying with Tesla's developer terms and for any costs Tesla may charge for use of the Fleet API under your own account.
7. Acceptable Use
You agree not to: (a) reverse engineer, decompile or modify the App; (b) use the App in any way that violates applicable law or Tesla's own terms; (c) attempt to gain unauthorized access to our systems; (d) use the App to harm others; (e) use the App to store or transmit malicious code.
8. Data and privacy
You retain ownership of the account and vehicle data associated with your use of the App. You grant us a license to process that data solely to provide the service to you. We do not sell your data. See our Privacy Policy for details.
9. Intellectual property
The App, including all associated content, trademarks, logos, graphics and software (other than the Tesla marks referenced in Section 3), is and shall remain the exclusive property of TeslSizzo and its licensors. No rights are granted to you other than the limited license in Section 1.
10. Third-party services
The App integrates with third-party services (the Tesla Fleet API, Firebase, Google AdMob, PayPal, the Apple App Store and Google Play). Use of those services is subject to their own terms and privacy policies.
11. Disclaimer of warranties
The App is provided on an "as is" and "as available" basis without warranties of any kind. Vehicle commands depend on network conditions, the Tesla Fleet API and your vehicle's state, and may be delayed or fail. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
12. Limitation of liability
To the maximum extent permitted by law, TeslSizzo shall not be liable for indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, arising from your use of the App.
13. Termination
We may suspend or terminate your access to the App if you breach this Agreement. You may stop using the App at any time by uninstalling it and cancelling any active subscription as described in Section 5.
14. Changes to these Terms
We may update this Agreement from time to time. When we do, we will update the "Last updated" date. Your continued use of the App after changes take effect constitutes acceptance of the revised Agreement.
15. Governing law
This Agreement is governed by the laws of your country of residence to the extent required by applicable consumer-protection laws; otherwise it is governed by the laws of Mexico.

17. App Store Specific Terms (Apple)
The following additional terms apply if you downloaded the App from the Apple App Store. They are required by Apple Inc. (Schedule 2 of the Apple Developer Program License Agreement) and form part of this Agreement:
- Acknowledgement: You and TeslSizzo acknowledge that this Agreement is concluded between you and TeslSizzo only, and not with Apple Inc. ("Apple"). TeslSizzo, not Apple, is solely responsible for the App and its content.
- Scope of License: The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may also be accessed by other accounts associated with you via Family Sharing or volume purchasing.
- Maintenance and Support: TeslSizzo is solely responsible for providing any maintenance and support services with respect to the App. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
- Warranty: TeslSizzo is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you (if any); to the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be TeslSizzo's sole responsibility.
- Product Claims: You and TeslSizzo acknowledge that TeslSizzo, not Apple, is responsible for addressing any claims of you or any third party relating to the App or your possession and/or use of the App, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
- Intellectual Property Rights: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, TeslSizzo, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such claim.
- Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer Name and Address: Any questions, complaints or claims with respect to the App should be directed to TeslSizzo at [email protected].
- Third-Party Terms of Agreement: You must comply with applicable third-party terms when using the App (for example, your wireless data services agreement).
- Third-Party Beneficiary: You and TeslSizzo acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that upon your acceptance Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.
